Terms of service

Conditions under which an organization and its users access the Motex platform.

1Purpose

These terms govern access to and use of the Motex platform, a software service that gathers, organizes, and makes queryable information about court cases for a legal department or a law firm.

The service includes downloading and classifying documents published by the Judiciary, extracting data from lawsuits, calculating deadlines, the hearing calendar, and the associated portfolio views.

This is a business-to-business contract: the client contracts the platform to integrate it into its own professional activity, not as an end consumer. Under that end-recipient criterion, Ley N.º 19.496 (Consumer Protection Law) probably does not govern this relationship — a criterion to be confirmed case by case with legal advice, not an automatic exclusion — and the contract is instead governed by the general rules of Chilean civil and commercial law.

Motex does not provide legal services. The platform delivers information and management tools. Decisions about each case are made by the client’s lawyers, under their exclusive responsibility.

2Account and access

  1. 1.Access is granted to the contracting organization, which administers authorized users and their permissions.
  2. 2.Credentials are personal and non-transferable. The user is responsible for how their account is used.
  3. 3.When a lawyer registers their password for Judiciary services, they represent that they are authorized to use it and to consult the cases in which they are involved.
  4. 4.The client must promptly report any unauthorized access it detects.
  5. 5.Motex may suspend a specific access when there is a well-founded security risk, informing the organization.

3Permitted use

The platform is used to manage the organization’s own cases. It is not permitted to:

  • Resell the service or grant access to third parties outside the organization.
  • Bulk-extract the platform’s content through automated means outside the intended channels.
  • Attempt to breach access controls or access another organization’s data.
  • Upload content one has no right to, or use the service for unlawful purposes.
  • Use the results of writ analysis to attribute authorship to a specific person: the analysis is an indicator, not proof.
  • Use the platform to surveil or monitor people with whom the organization has no procedural relationship in the relevant case. The service is provided to assist the client in cases that concern it, not to investigate third parties unrelated to them.

4Intellectual property

The platform, its code, its design, its data models, and its documentation belong to Motex or its licensors. The contract grants the client a non-transferable license to use it, limited to the term of the service.

Content the client uploads remains the client’s. Nothing in these terms transfers ownership of that information to Motex.

Each party’s trademarks, names, and logos are used only with prior written authorization.

5Client data

The platform is provided to assist the client — or its lawyer — in exercising its right of action or defense, in cases that concern it. By contracting the service, the client represents that it has a legitimate interest in the cases it manages through the platform.

Regarding the data the client uploads or consults, Motex acts on the client’s behalf and according to its instructions. The following commitments apply:

Isolation
Each organization operates in a sealed environment. One organization’s data is never mixed with another’s.
No model training
Client information is never used to train third-party models.
Encryption
Data is encrypted in transit and at rest.
Control
The client may export or delete its information whenever required.

The processing of personal data is further governed by the privacy policy.

6Service availability

Motex works to keep the platform continuously available, with planned maintenance outside business hours whenever possible.

Part of the service depends on external sources, in particular the Judiciary’s own systems. If those sources change, fail, or stop publishing information, a case’s update may be delayed. That delay does not constitute a breach.

The committed service level, if any, is defined in each organization’s contract or in a specific exhibit.

7Liability

The service is provided with professional diligence, without guaranteeing procedural outcomes.

  1. 1.The client is responsible for verifying deadlines, hearings, and the content of documents before acting. The platform is a management aid, not a substitute for a lawyer’s own oversight.
  2. 2.Results generated with language models may contain errors. Every relevant statement must be checked against the source the platform cites.
  3. 3.Writ analysis provides a per-paragraph estimate. It does not determine the authorship of a text nor does it serve as proof on its own.
  4. 4.To the extent permitted by law, Motex’s liability to the client is limited under the terms set by the contract. That limit never reaches damages caused by Motex’s willful misconduct (dolo) or gross negligence (culpa grave): Chilean law does not allow liability for those cases to be waived or limited in advance (Article 1465 of the Código Civil — Civil Code), and this clause is always interpreted subject to that limit.

8Price and billing

Price, billing frequency, and payment method are agreed upon in each organization’s contract. This site does not publish prices.

Adjustments, applicable taxes, and the consequences of late payment are defined in that same contract.

9Term and termination

  1. 1.The service is contracted for the agreed period and renews as agreed.
  2. 2.Either party may terminate the contract with the prior notice established.
  3. 3.Motex may suspend the service for serious breach or misuse, with prior notice, except in cases of immediate security risk.
  4. 4.Upon termination, the client has 30 calendar days to export its information. Once that period has elapsed, the data is deleted, unless there is a legal obligation to retain it.

10Governing law

MOTEX CHILE SpA is a Chilean company and its clients are, in general, Chilean companies. This contract is governed by Chilean law, and any dispute is submitted to the ordinary courts of Santiago.

This clause cannot displace the Chilean public-order rules that apply to the case — such as the limit in section 7 regarding willful misconduct and gross negligence, or the personal data protection regime when applicable.
